Terms & Conditions

1. About The Denim Atelier

The Denim Atelier is operated by SAM AND NIK COMPANY, GSTIN 27BBRPS1351R1ZQ, from:

India House, Building No. 1, Ground Floor, Behind Enrich/Bharat Furnishing, Kemps Corner, Mumbai – 400036, Maharashtra, India.

These terms govern purchases and services provided through The Denim Atelier. Our Payment Policy, Shipping Policy and Returns / Cancellation Policy form part of the terms applicable to your order. Our Privacy Policy explains how personal information is handled.

Nothing in these terms excludes rights that cannot lawfully be excluded.

2. Orders and customer information

Please provide accurate contact details, delivery information and order requirements. If you create an account, keep its credentials confidential.

An enquiry or consultation request does not itself confirm a production order. Product availability, pricing, payment requirements and custom specifications must be confirmed before fulfilment.

If we cannot accept or fulfil an order, we will notify you and refund any amount received for the unfulfilled order.

3. Prices and payments

The applicable currency, price, taxes and delivery charges will be stated at checkout or in your written quotation before payment.

Ready-stock orders require full payment before dispatch. Custom-order payment arrangements will be communicated and agreed before production.

Cash on delivery is not available.

If a pricing error is identified, we will explain it and offer you the choice of accepting the corrected price or cancelling for a refund. We will not collect additional payment without your agreement.

4. Custom-made and clone orders

Custom garments are produced using the measurements, fabric and design details approved for the order.

Please review these details carefully before approval. Tell us promptly if you believe a measurement is incorrect or need a change.

Changes may not be possible after fabric cutting or personalisation begins. Any additional work or cost must be agreed before proceeding.

For clone orders, the reference garment helps us assess fit and construction. Differences in fabric weight, stretch, wash and condition can affect how the new garment feels and fits. Exact duplication of a worn garment’s appearance or ageing is not promised. Any material limitations will be discussed before production.

Our responsibility for errors in our own measurement-taking, production or fulfilment remains unaffected.

5. Product appearance and care

Photographs and screen settings may cause differences in perceived colour. Fabric characteristics can also affect drape and fit.

These normal variations do not excuse supplying a materially different product from the one agreed.

Follow the care instructions supplied with your garment. Damage caused by inappropriate washing, bleaching, drying or third-party alterations may affect whether subsequent work is technically possible, but does not remove unrelated statutory rights.

6. Delivery

Estimated delivery within India is:

International orders require separate confirmation of availability, payment, shipping charges and delivery estimates.

If additional time is needed, we will communicate the revised estimate. Our Shipping Policy explains tracking, delays, unsuccessful delivery and service shipments.

7. Returns, cancellations and refunds

Ready-stock products, including sale and discounted items, have a seven-calendar-day return or size-exchange request window after delivery, subject to the conditions in our Returns / Cancellation Policy.

Custom orders may be cancelled before fabric cutting or personalisation begins. After that stage, change-of-mind cancellations, returns and refunds are not available, subject to applicable law.

Restrictions on voluntary returns do not exclude remedies for defects, incorrect supply or failure to meet agreed specifications.

Approved refunds will be initiated within seven working days of approval, or sooner where required by law. Bank or payment-provider processing may take additional time.

8. Lifetime Minor Repairs & Alterations

Eligible ready-stock, custom-made and clone jeans purchased directly from The Denim Atelier receive free minor repairs and fit alterations for the usable life of the original garment. Sale and discounted purchases are included.

The benefit depends on technical feasibility and garment condition. It does not promise replacement jeans, complete remakes, major resizing or reconstruction of extensively worn-out fabric.

Customers must send photographs and receive shipping instructions before sending a garment. Initial assessment from photographs is subject to physical inspection after receipt.

Shipping responsibility is as follows:

The 30-day domestic shipping benefit does not restart after service. If physical inspection establishes that work is not feasible, the applicable shipping rules still apply when returning the garment.

Full eligibility, assessment and shipping conditions are set out in our Returns / Cancellation Policy. These provisions do not override remedies due for defects or errors on our side.

9. International orders

International orders and service shipments require our prior acceptance and are subject to destination serviceability and applicable import/export requirements.

Applicable transportation costs, duties, taxes and customs-related charges are the customer’s responsibility unless expressly agreed otherwise or applicable law requires a different arrangement.

We do not deduct transportation or customs charges that were never incurred. Any permitted deduction associated with a cancellation or voluntary return will be explained.

Mandatory consumer rights applicable to an international purchase remain protected.

10. Website content and permitted use

Website text, photographs, branding and other materials are owned by or used with permission by their respective rights holders.

You may use the website to browse, make enquiries and purchase our products. Unauthorised commercial copying, impersonation, interference with website operation or misuse of customer accounts is prohibited.

Nothing in this clause restricts uses permitted by applicable law.

11. Privacy

Personal information is handled as described in our Privacy Policy.

Do not send payment passwords, PINs, CVVs or one-time passwords through our enquiry forms, email or messaging channels.

12. Complaints and resolution

Please contact us with your order reference and a clear description of your concern.

Consumer grievances will be acknowledged within 48 hours and addressed within one month.

Contacting us does not remove or postpone any right to approach a competent consumer commission, regulator or court.

13. Governing law and jurisdiction

These terms, and contractual disputes arising from purchases or services provided by The Denim Atelier, are governed by the laws of India.

To the extent permitted by applicable law, courts of competent jurisdiction in Mumbai, Maharashtra, India shall have exclusive jurisdiction over such disputes.

This clause does not exclude or restrict the jurisdiction of consumer commissions or other authorities conferred by law. It does not prevent a consumer from bringing proceedings in another forum where mandatory law gives that right.

For international customers, any mandatory protections that cannot lawfully be excluded remain unaffected.

14. Changes and interpretation

We may update these terms for future orders. Changes will not retrospectively reduce benefits or rights agreed for an existing purchase.

The terms and policies applicable when an order is accepted will govern that order, together with any expressly agreed written specifications, subject to mandatory law.

If any provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
